Copyright Policy

Copyrights and Designated Agent for Notification of Claims of Infringement.

Because our marketplace is based on the remuneration of copyright holders, we respect all copyright laws in the United States and internationally and we expect our members to obey those rules. Members submitting content to Cutcaster have warranted that they are the copyright holders, or authorized agents of the copyright holders, for all content submitted.

Willful violations of copyright are considered the most severe breach of the user agreement and are punishable by a permanent ban from the site. Copying or tracing copyrighted work, or uploading work that is not your own, will cause for permanent ban from the site. We will not enable any form of plagiarism, or any infringement of intellectual property rights. This includes copying work that already exists on Cutcaster.com.

Where any product has a disputed copyright, Cutcaster will withhold any revenue due to the seller for sales of the product. Such revenue will be remitted to the legitimate copyright owner once that is determined. Copyright violations and content piracy may also be reported to third parties including, but not limited to, other Royalty Free/Rights Managed Stock agency sites, the Cutcaster™ community, and the original copyright holder of the work in question. Please contact Client Relations with any instances of copyright violation as soon as possible for investigation.

Cutcaster has adopted the notification and takedown policies of the Digital Millennium Copyright Act of 1998. Mezzato Inc, the owner of Cutcaster, respects the intellectual property of others, and we ask our users to do the same. If you are a copyright owner, or the authorized representative of a copyright owner, you may report an alleged infringement by contacting Cutcaster Designated Copyright Agent (John at John@cutcaster.com) with a written communication that includes substantially the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or the subject of infringing activity, and that is to be removed. Cutcaster also needs information reasonably sufficient to locate the material, but in no event less than: product name, submitting member name, file size, and date submitted.
  • Information reasonably sufficient to permit Cutcaster to contact you, such as an address, telephone number, and, if available, an e-mail address at which you may be contacted.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copy-right owner, its agent, or the law.
  • A statement that the information in the notification is accurate, under penalty of perjury, and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
